These Terms apply to all visitors, users, and others who access or use the Service, including our eBooks and coaching programs.


Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.


These Terms of Service apply to all current and future products or services we may offer through the Service.

Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, and your billing address.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.


By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases. We use industry-standard payment processors, including Stripe and PayPal, to facilitate secure transactions.


We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.


We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected. We will not be held responsible or liable for any failure for the Purchase to complete, or any resulting loss or damages to you.


All digital products and services are delivered electronically. We do not offer shipping of physical products at this time.


Refund policies for specific products or services, including our 30-day money back guarantee for eBooks and our refund policy for coaching programs, are detailed in separate sections of these Terms or in the specific product descriptions.


Any complimentary items or bonuses provided with our services are offered at our discretion and do not affect the terms of the primary purchase.

Availability, Errors and Inaccuracies

We strive to provide accurate and up-to-date information about our products and services. However, errors may occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.


1. Pricing and Availability: Prices and availability of our products and services are subject to change without notice. We reserve the right to modify or discontinue any product or service without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the service.


2. Coaching Programs: Availability is limited and subject to change. Please check our website for the most current scheduling information.


3. Digital Products: While eBook content remains mostly static, we may update or add complementary materials at our discretion.


4. Accuracy of Information: Health and nutritional information may change over time. We recommend consulting with a healthcare professional for personalized advice.


5. Technical Issues: In case of technical problems with our digital products, please contact our support team for assistance.


6. Results: Individual results from our programs may vary. Examples of results are not guarantees of similar outcomes for all participants.


We are not responsible for any errors or delays in responding to a request or referral caused by an incorrect email address or other contact information provided by you or for any other technical problems beyond our control.


By using our Service, you acknowledge that errors and inaccuracies may occur, and you agree to the terms outlined in this section regarding how we handle such situations.

Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.


You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.


You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.


We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.


For participants in our WildFit 90-Day challenges, additional community guidelines apply to interactions within our Facebook group. These guidelines are provided separately and form part of these Terms of Service.


Account Security Best Practices:

- Use a unique, strong password for your account

- Enable two-factor authentication if available

- Do not share your account credentials with others

- Log out of your account when using shared devices


Account Deletion: If you wish to delete your account, please contact our support team. We will remove your personal information in accordance with our Privacy Policy.


Inactive Accounts: We reserve the right to terminate inactive accounts after a period of 12 months of inactivity.


You agree not to allow others to use your account, impersonate any person or entity, including our coaches or employees, or falsely state your affiliation with a person or entity. If you suspect any unauthorized use of your account or any impersonation attempts within our services or community, please notify us immediately.

Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content on our Service infringes upon your copyright, please notify us at support@freedomfoodcoach.com.


Your notification should include:


1. A description of the copyrighted work that you claim has been infringed

2. The URL where the allegedly infringing content is located

3. Your contact information (address, telephone number, and email address)

4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law

5. A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or are authorized to act on behalf of the owner


We will review your claim and take appropriate action, which may include removing the infringing content or terminating the accounts of repeat infringers.


While we do not control content shared by users on third-party platforms (such as Facebook), we take copyright infringement seriously and will cooperate with copyright owners to address valid concerns within our sphere of control.

The Service and all contents, including but not limited to text, images, graphics, logos, button icons, audio clips, digital downloads, data compilations, and software, are the property of FreedomFoodCoach or its content suppliers and are protected by international copyright laws.

Potential risks of external links include inaccuracies, security issues, phishing attempts, misrepresentation of relationship with us, and content changes over time.

We reserve the right to remove links to sites we believe may harm our users. Your use of external sites is subject to their respective terms and policies.

Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.


Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us for account deletion.


Termination may result in the forfeiture and destruction of all information associated with your account, including any purchased digital products or ongoing coaching services. FreedomFoodCoach is not responsible for any loss of data or content resulting from termination.


All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.


If you have signed up for a coaching program or purchased digital products with ongoing access, termination may affect your ability to access these services. Refunds, if applicable, will be handled in accordance with our refund policy.


We reserve the right to terminate or suspend service to anyone for any reason at any time, in addition to the specific circumstances outlined in these Terms.

Indemnification

You agree to indemnify, defend and hold harmless FreedomFoodCoach, its principals, officers, directors, representatives, employees, contractors, licensors, licensees, suppliers, agents, guest coaches, content creators, and invited experts, from and against any claims, losses, damages, obligations, costs, actions or demands.


These include but are not limited to:


(a) legal and accounting fees resulting from your use of the Service;

(b) your breach of any of these Terms;

(c) any misuse or misinterpretation of the information, advice, or content provided through the Service;

(d) any activity related to your account or use of the Service; and

(e) any claims related to the efficacy of our coaching methods, products, or services.


This includes any negligent or illegal conduct by you, any person or entity accessing the Service using your account whether such access is obtained via fraudulent or illegal means.


This indemnification obligation will survive the termination of these Terms and your use of the Service.


FreedomFoodCoach reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall FreedomFoodCoach, its directors, employees, partners, agents, suppliers, guest coaches, content creators, or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:


(i) your access to or use of or inability to access or use the Service;

(ii) any conduct or content of any third party on the Service;

(iii) any content obtained from the Service; and

(iv) unauthorized access, use or alteration of your transmissions or content,


whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.


Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

FreedomFoodCoach makes no guarantees, representations or warranties of any kind as regards the website and associated technology. Any purportedly applicable warranties, terms and conditions are excluded, to the fullest extent permitted by law.


Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance, except as provided for under the laws of any province in Canada. In such cases, the provincial law shall apply to the extent necessary.


FreedomFoodCoach, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.


We strive to ensure that all material facts about our Service are clearly disclosed in compliance with Manitoba's Consumer Protection Act. However, the results obtained from using our Service can vary significantly between individuals. Factors such as personal effort, consistency, pre-existing conditions, and individual circumstances can all affect outcomes. We do not guarantee that you will achieve any specific result from using our Service.


While we take reasonable precautions to protect your personal information, please be aware that no method of internet transmission or electronic storage is 100% secure. We cannot guarantee the absolute security of your data.


FreedomFoodCoach is not responsible for any technical issues, interruptions, or errors caused by third-party platforms or services that we may use to deliver content or services.


If you breach any of these Terms and FreedomFoodCoach chooses not to immediately act, or chooses not to act at all, FreedomFoodCoach will still be entitled to all rights and remedies at any later date, or in any other situation, where you breach these Terms. FreedomFoodCoach does not waive any of its rights. FreedomFoodCoach shall not be responsible for any purported breach of these Terms caused by circumstances beyond its control.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations in these Terms may not apply to you in full or in part.


These Terms shall be governed by and interpreted in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to principles of conflicts of laws. The United Nations Convention on Contracts for the International Sale of Goods will not apply to these Terms.


You agree that any dispute arising from or relating to these Terms will be resolved through binding arbitration, except that either party may take claims to small claims court if they qualify. The arbitration will be conducted in Manitoba, Canada, unless you and FreedomFoodCoach agree otherwise. If you reside outside of Canada, the arbitration will be conducted online.


Nothing in these Terms will be deemed to waive, preclude, or otherwise limit any rights that you may have under applicable consumer protection laws.


If you are a consumer, the provisions in these Terms are intended to be only as broad and inclusive as is permitted by the law of your country of residence.

Changes

We reserve the right to modify these Terms at our sole discretion. If we make material changes to these Terms, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.


We will notify you of changes by posting the updated terms on our website and sending an email to the address associated with your account. It is your responsibility to ensure we have your current email address.


By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.


We encourage you to review these Terms periodically for any changes. Changes to these Terms are not expected to be frequent, but when they occur, your continued use of the Service following the posting of changes will confirm your acceptance of those changes.

No Medical Treatment Disclaimer

FreedomFoodCoach provides educational resources and coaching to support lifestyle changes, particularly in nutrition and wellness. We are not acting as medical professionals, and our services are not a substitute for professional medical advice, diagnosis, or treatment.


Key points:


1. Consult your healthcare provider before making significant changes to your diet, exercise routine, or health regimen, especially if you have pre-existing conditions or take medications.


2. Our services are for informational purposes only and have not been evaluated by Health Canada or the FDA. We do not diagnose, treat, cure, or prevent any disease.


3. Results vary among individuals. We do not guarantee specific health outcomes, weight loss, or treatment of medical conditions.

WildFit Challenges

WildFit works because it provides an excellent combination of solid nutritional information, carefully staged progression, and behavioral-change coaching.


We are so confident it works that we offer a 100% Satisfaction Guarantee.


If you complete the full program and do not feel that your health has improved then we will refund your money in full.


If you invested in the WildFit 90-Day Challenge clearly you intend to complete it. For the purpose of our Guarantee, we have defined what completing the program means. It does not mean doing everything completely and perfectly. Our Total Satisfaction Guarantee requires a minimum level of participation in the program which includes:


(a) Watching at least 75% of the WildFit videos in their entirety.

(b) Completing and uploading at least the starting, midpoint and ending measurements.

(c) Completing at least two 'daily check-ins' per week.

(d) Posting (any content) in the 90-Day Challenge Facebook group at least 10 times during the program.
